Woman charged with impaired driving, heroin possession

Charges laid after Nottawasaga OPP responded to single-vehicle collision Sunday morning in Adjala-Tosorontio

On Sunday, Aug. 16, 2020, at approximately 9:34 a.m., members of the Nottawasaga Detachment of the Ontario Provincial responded to a single motor vehicle collision on Concession Road 3, just south of the 30th Side Road, in Adjala-Tosorontio Township.

Officers attended the area and spoke with a witness and the driver of the motor vehicle. As a result of the investigation, the driver of the motor vehicle was arrested at the scene of the collision. The accused was transported to a local hospital for medical assessment as a precaution.

Samantha McPhail, 31 years old, of Clearview Township, has been charged with the following offences:

  • Operation while impaired - alcohol and drugs, contrary to s.320.14(1)(a) of the Criminal Code of Canada (CC);
  • Possession of a schedule 1 substance - heroin, contrary to s.4(1) of the Controlled Drugs and Substances Act;
  • Fail to have insurance card, contrary to the Compulsory Automobile Insurance Act (CAIA);
  • Drive motor vehicle- no licence, contrary to s.32(1) of the Highway Traffic Act (HTA);
  • Use plate no authorized for vehicle, contrary to s.12(1)(d) of the HTA.

The driver was also issued a 90-day licence suspension and seven-day vehicle impoundment.

The accused is scheduled to appear in the Ontario Court of Justice in Bradford on Sept. 10, 2020.

The Nottawasaga OPP would like to express gratitude to members of the public who assisted in reporting this impaired driver. Anyone who suspects an impaired driver by either alcohol or drug is encouraged to call 9-1-1 and report it.
