Jury deliberations could begin tomorrow in beating trial (update)

Crown about to begin final submissions in trial centering on 2012 attack

 4:06 p.m. update:

A judge is scheduled to deliver her final instructions to a Barrie jury tomorrow.

Justice Susan Healey will instruct the four men and eight women panel on the law.

Then jurors will retire to consider a verdict in the aggravated assault trial of two cousins.

The crown and defense lawyers presented their closing arguments today.

The crown attorney at a Barrie assault trial began his closing arguments by showing a video of the attack to the jury.

The brief cell phone video has been entered as evidence at the trial of two men charged with aggravated assault.

Courtney Lewis, 26, and his cousin Aaron Lewis, 23, have pleaded not guilty.

31-year old Ryan Turcotte of Barrie suffered a debilitating head injury during what the crown called a "fast, violent, vivacious attack."

"Ryan Turcotte was attacked, surrounded, punched and kicked from every direction, knocked to the ground and it ended in a thump," prosecutor Indy Kandola said.

The beating occurred on June 26, 2012 after Turcotte had stepped off a bus from the Kee to Bala.

The crown contends there is direct and circumstantial evidence that both accused were involved in the attack.

During their closing arguments, defense lawyers urged the jury to acquit both men.

Craig Bottomley and Heather Pringle told jurors that they can't rely on Turcotte's evidence because he is suing the accused men.

"Mr. Turcotte has 5 or 6 million reasons to lie.  If there's a conviction it gets easier to get that money," Pringle said.

But the crown countered by telling jurors that even if they ignored Turcotte's evidence, the 12-member panel can still find the accused men guilty.

Defense lawyers for two men on trial for aggravated assault have wrapped up their closing arguments.

The Crown is about to begin it's final submissions.

Lawyer Craig Bottomley represents 23-year-old Aaron Lewis.

Bottomley told the jury that his client was not responsible for the June 26, 2012 attack that left Barrie resident Ryan Turcotte with a debilitating brain injury.

"It's not enough to be near a crime" to convict someone of a crime, Bottomley said.

Lawyer Heather Pringle also urged the jury to acquit her client, 26-year old Courtney Lewis.

"You may feel personal sympathy for his (Turcotte's) situation but that's not evidence," Pringle said.
