RIDE check leads to impaired charge

TINY TOWNSHIP - On Apr. 29, 2017 at approximately 10:23 p.m. officers from the Southern Georgian Bay Detachment of the Ontario Provincial Police (OPP) were conducting a RIDE (Reduce Impaired Driving Everywhere) check at Lafontaine Road and County Road 6, Tiny Township, Ont.

A lone male approached the officers in a Chevrolet vehicle. Upon speaking to the male driver, an officer determined that he had been consuming alcohol. The officer requested the driver pull the vehicle off the road onto the shoulder. The driver then proceeded to move forward in an attempt to leave the RIDE check. Officers were able to stop the vehicle and the driver was subsequently arrested for impaired driving.

A further police investigation into the driver and his motor vehicle revealed that he was in possession of a quantity of Cannabis Marijuana.

Michael Vito Leo (age 52) of Penetanguishene, Ont. has been charged with:

  • Driving while ability impaired - Alcohol contrary to the Criminal Code of Canada
  • Driving with more than 80 mgs. of Alcohol contrary to the Criminal Code of Canada
  • Possession of a schedule II substance - Cannabis Marijuana - Under 30 grams contrary to the Controlled Drugs and Substances Act

The accused received an automatic 90-day driver's licence suspension and his vehicle was impounded for seven days.

The accused is scheduled to appear in the Ontario Court of Justice on May 11, 2017 in Midland, Ont.
