Crown drops charge against OPP Const. Mark Lund

An OPP officer who was facing one count of attempt to obstruct justice has had the charge withdrawn by the Crown.

Const. Mark Lund is the father of Shayne Lund, who was recently designated a dangerous offender for sex crimes against children. 

"I can confirm that on October 27, 2016, one count of Attempt to Obstruct Justice was withdrawn by the Crown," said Brendan Crawley, spokesperson for the Ministry of the Attorney General.

No specific reason was given as to why the charge was dropped. 

"In all cases, the Crown has an ongoing obligation to assess the strength of a case throughout a prosecution and is duty-bound to either stay or withdraw the charges if there is no reasonable prospect of conviction, or if it is not in the public interest to proceed," said Crawley.

The police did not release any details of the allegation against Lund. 

His lawyer Bernard Cugleman did not offer any specifics but said the charge related to Shayne Lund's case but not the sex offences.

"It was based upon the flimsiest of grounds and the crown attorney quickly realized that there was no reasonable prospect of conviction whatsoever based upon what the allegation was," Cugleman said. "He had absolutely nothing to do with anything that his son did."

Lund was not in Midland court Thursday when the charge was withdrawn because Cugleman said it wasn't necessary for Lund to attend.

"He was obviously very pleased that that happened," Cugleman said. "Unfortunately when somebody is charged and it's put out into the media then there's a lot of very adverse reaction and consequence to that person. Hopefully with the charges dropped like that the record might at least reflect that."
